General Terms and Conditions

For the business relations of any kind between the company Seggelke Klarinetten GmbH & Co. KG and the customer, the following terms and conditions apply in their respective valid version.

Deviating conditions or general terms and conditions of the customer are not valid, unless otherwise agreed in writing.

Offer
Our offer is subject to change with regard to delivery time, delivery possibility and price. We reserve the right to make technical changes and price changes.

Prices for orders in the online store
The price displayed in the store is binding; the applicable VAT of the recipient country applies. Shipping costs are calculated depending on the value of goods.

Prices for direct contact

The price agreed in the order confirmation shall be binding; in the case of goods in stock, the price list valid on the day of delivery shall apply. Verbal price agreements shall only be valid if they have been confirmed by us in writing.
Configurators
Our configurators serve as a guide and basis for creating a concrete offer. The calculated prices are non-binding. The prices stated in the offer are always valid.

Terms of payment for goods in stock

You can choose from the following three payment options:

  • Prepayment by bank transfer
  • Invoice (Payments by invoice are possible from the third successful order with us. The payment term is 7 days. Until then prepayment is valid).
  • PayPal

All reed shipments are excluded from exchange and return for hygienic reasons.

Terms of payment for commissioned instrument work
The order is confirmed by the customer with an advance payment of 30%. A further payment of 30% is due after half of the production, the remaining invoice amount immediately upon delivery. If the buyer defaults on payment of the purchase price, interest of 5% above the respective base discount rate shall be charged on the amount of the purchase price during the period of default. If Seggelke Klarinetten GmbH & Co. KG can prove a higher damage caused by delay, it is entitled to claim this.

Deliveries
The basis of delivery of instruments is the receipt of payment of the invoice amount. The delivery is made by a transport company and is insured from door to door. A possible return transport in case of revocation or in case of warranty is also insured by us. No claim for damages or right to withdraw from the contract can be derived from non-compliance with the delivery time.

Custom-made products

In the case of custom-made products, a deposit of 50% of the total value of the goods must be paid upon receipt of the order confirmation. This applies to goods that are not listed in our configurator or our price list. The order will not be processed until this payment has been received. Custom-made products are excluded from return, this also applies to custom-made cases.

Customer service prices

The price for services on our instruments outside of the warranty is €70/hour, for instruments from other manufacturers €100/hour, plus any materials and VAT.

Valuation reports / Cites certificates

For instruments purchased from Seggelke Clarinets, we can provide appraisals and Cites certificates on request. The price for this is €10.

Sample shipments

We charge an insurance and postage fee of €23.80 for sample and inspection shipments of accessories within Germany, and a cleaning fee of €10 if required. We charge a fee of €75 for processing, shipping and insurance for instruments sent for inspection. The return of instruments within Germany is included, please contact us for a return slip. For shipments abroad, the fee increases according to the respective postage rates. This fee will be credited when a purchase contract is concluded.

Cancellation policy
The customer has the possibility, without giving reasons, within 14 days to return the delivered goods, or to withdraw from the purchase contract. The goods must be returned to us by return label in proper condition, without signs of use and in original packaging, and free from third party rights. Timely dispatch shall be sufficient to meet the deadline. If the customer makes use of his option to return the goods after the 14-day period, Seggelke Klarinetten GmbH & Co. KG is entitled to demand an appropriate usage fee for the time the goods remain with the customer.


Warranty

The company Seggelke Klarinetten GmbH & Co. KG warrants that the sold goods are free from material and manufacturing defects at the time of delivery and that they have the contractually warranted characteristics. Upon arrival of the goods, the customer must immediately inspect them for defects and condition. In case of obvious or hidden defects, these must be reported to us in writing within 10 days. Thereafter, the warranty for these defects shall lapse. The legal warranty is 24 months from delivery. In the event of a complaint, the item must be sent in together with a copy of the invoice to prove the date of purchase.

The warranty does not apply to normal wear or tear of stressed parts or material. The warranty shall also not apply in the event of improper intervention by the customer or third parties, or in the event of improper storage or handling. During the warranty period, the company Seggelke Klarinetten GmbH & Co. KG has the right to rectify defects free of charge. If defects are not remedied within a reasonable period of time, the buyer shall be entitled to rescission or reduction (§476a BGB). External transport damage to the packaging must be confirmed in writing by the carrier (DHL, DPD, UPS) and must be reported to us immediately.

When purchasing a Schwenk & Seggelke or JSB clarinet, a free intonation check is also included in the first 12 months from the date of purchase. This includes 1.5 hours of working time per instrument. Any additional individual adjustments (e.g. due to a change of mouthpiece) and necessary repair work will be charged separately.

Retention of title
The goods shall remain our property until full payment has been made, even in the event of resale before full payment has been made. If the goods are seized by a third party, the customer is obliged to notify us immediately by registered mail.


Place of performance

The place of performance and jurisdiction for all services arising from the business relationship existing with the company Seggelke Klarinetten GmbH & Co. KG is Bamberg. By confirming the order, the client acknowledges the binding nature of our general terms and conditions. The law of the Federal Republic of Germany shall apply exclusively.


Final clause

Should any of these provisions, for whatever reason, not be applicable, this shall not affect the validity of the remaining provisions.
